Our son, the Fort Bliss Whistleblower Hero Soldier Richard Halliday, was murdered in the line of duty—because he stood up against military-linked cartel criminal trafficking on a U.S. Army base. Bill "the Usurper" Hicks earned his nickname by illegally occupying El Paso's

34th Judicial District Attorney’s office without proper installation while also

enabling cartel-linked corruption in El Paso's justice system.

In December 2022, Texas Governor Greg Abbott appointed Bill Hicks as the 34th Judicial District Attorney in El Paso. But here’s what didn’t make the headlines: Mr. Hicks never legally installed into office. Instead, evidence confirms he tampered with official records to cover up his failure—while gaining power over one of the most critical border regions in the country.

Then it got worse. Bill "the Usurper" Hicks hired Luis René Diaz as his Chief of Staff, despite having a criminal history. Luis René Diaz was arrested and indicted in New Mexico for extortion, conspiracy to extort, fraud, and making false public vouchers. According to court records and media reports, Diaz was arrested alongside Arturo Alba, his co-defendant and a known associate of Mexican cartel networks. Arturo Alba was executed in a cartel-style killing in October 2020, and his wife, Lorrilly Chavira, is related to Wilfredo “Willie” Moya—a major cartel figure involved in money laundering in Juarez, Mexico, who was also shot and killed in a cartel-style execution. To conceal these associations, "The Usurper" Hicks ordered Luis René Diaz’s background check to be waived, despite Luis René Diaz being unqualified for the position that granted him access to El Paso's sensitive law enforcement intelligence, investigations, and operations.—all paid for by Texas taxpayers. When we brought these issues directly to Bill Hicks, halted investigations into Richard’s murder, cartel infiltration at Fort Bliss, and the fraud involving the Walmart mass shooting victims fund (over $12 million) in order to prevent any exposure of his Chief of Staff, Luis René Diaz.

This cartel access in a high-level law enforcement office in El Paso—the gateway to the United States—has led to multiple allegations that "The Usurper" Hicks tampered with evidence and intentionally obstructed justice in the prosecution of the Walmart mass shooting "mutiny" case that cost taxpayers millions of dollars. "The Usurper" Hicks refused to order a mental competency evaluation for Patrick Crusius, one of the Walmart shooters—despite a long history of documented evidence of serious mental health and developmental conditions. That’s not just reckless. Under Texas law, it’s illegal.

To make matters worse, multiple judges—including Judge Roy Ferguson and Judge Ruben Morales—have publicly accused "The Usurper" Hicks of tampering with evidence and official documents. Even Loretta Lynn Hewitt, the lead prosecutor on the Walmart case, has gone on record accusing Hicks of destroying case evidence. And let’s not forget: When "The Usurper" Hicks was appointed by Governor Abbott, he already had pending lawsuits for breach of contract, multiple complaints with the State Bar of Texas, years of unfiled tax returns, and a clear conflict of interest involving a client connected to the Walmart mass shooting case.

Even worse? "The Usurper" Hicks halted an investigation into the infiltration of a cartel-connected individual named Manuel Chavira of the El Paso Independent School District. Please be aware that Mr. Chavira was unlawfully appointed as the Chief of Police of EPISD without holding a peace officer's license. He is also connected by family to Wilfredo “Willie” Moya and Arturo Alba, who, as we previously mentioned, was the codefendant of Luis René Diaz when they were arrested and indicted for extortion, conspiracy to commit extortion, fraud, and making false public vouchers. And yet, he’s in charge of school safety?

Bill Hicks even admitted to illegally spying on the duly elected District Attorney, Yvonne Rosales, trying to access her office’s confidential data while attempting to force her out.

This confirms cartel infiltration of the DA's office—the same institution meant to protect whistleblowers like Richard as he exposed military-linked cartel trafficking, leaving him defenseless when he needed justice most.

More than 10 Timestamped Events That Prove Bernabe’s Negligence and Cover-up

July 23, 2020 – The soldier assigned to 24-hour protection of Richard Halliday failed to report for duty. He did not show up. Eyewitnesses later revealed that Richard Halliday was seen being forcibly removed from his room in uniform, against his will. Despite this, the required mandatory notification to his family regarding his disappearance was never made. Richard Halliday disappears from Fort Bliss, and Army leadership does nothing for over a month. When social media starts reporting virally on his case, Army leadership immediately pushes the AWOL narrative without conducting a real investigation.

August 28, 2020 – Fort Bliss officials admitted that they had failed to notify the Halliday family that Richard was missing for over 30 days. However, they told the family that they could not take any action unless the family provided leads.

September 26, 2020 – Some of Richard’s missing personal items were later discovered in the possession of another soldier in his unit, along with a woman connected to the Mexican trafficking cartel. This woman also has ties to the mother of Richard’s platoon leader, further linking the crime to a network of corruption, but LTG Bernabe ignored them and the breach in security.

October 2020 – Palestinian FBI agent Nidal Baem was caught on CCTV footage confirming that Richard's remains were found by the FBI in Juárez, Mexico, and that it was a secret. Nidal Baem is the father-in-law of LTC Bradford Bugado, who is in Richard Halliday's command, in G3. Additionally, LTG Bernabe lied to the Halliday family about the identity of Nidal Baem, calling him a nobody. Army CID and the FBI received reports about cartel-tied trafficking at Fort Bliss, but LTG Bernabe ignored them.

November 9, 2020 – The Halliday family reported leaks in their son's case at the first ‘Task Force Find Richard Halliday’ meeting. Despite the participation of over 15 agencies, including international organizations, all military personnel, including Army generals, attended in civilian clothing, and no official operational order was issued, suggesting that the initiative was more of a façade than a legitimate effort—revealing it to be a sham. The total estimated cost of this charade was in the tens of thousands of dollars.

November 20, 2020 – BORSTAR had a positive hit on human remains at a site on Fort Bliss. LTG Bernabe denied this information to the Halliday family after calling them in for a meeting and blocked further searches.

December 2020 – LTG Bernabe deployed teams during the Christmas holiday to search a mock Afghanistan training village on Fort Bliss for Richard Halliday's remains without notifying the Halliday family.

January 14, 2021 – LTG Bernabe ordered an investigation into Richard’s unit but failed to address CID/FBI corruption.

May 2021 – Army leadership met privately with the Halliday family, falsely claiming “there is no evidence of foul play,” despite internal reports stating otherwise.

January 2022 – LTG Bernabe received a whistleblower complaint from Judge Roger Rodriguez regarding leaks made by Fort Bliss CID Agent Tavita Nuusa to family members, including convicted criminal Leilani Hart and her son, Dallas Wayne Hart, who was Richard's platoon leader. LTG Bernabe failed to notify Richard Halliday’s family about this report, which was subsequently whitewashed and did not progress in Richard Halliday's case file to the Cold Case Homicide Unit (CCU) CID Agent Todd Howell.

Both Vannesa Guillen and Richard Halliday were young soldiers with promising futures, and both were part of the U.S. Army’s military family. Both suffered retaliation for their courageous efforts to expose wrongdoing and unethical behavior within their ranks.
